BFTA founding partner Javier Bleichmar and senior associate Cynthia Hanawalt authored an analysis of IndyMac in the Outside Counsel column of the New York Law Journal.  The article addresses the complexities that may arise from the Supreme Court’s recent withdrawal of certiorari in IndyMac, leaving intact the split between the Second and Tenth Circuits on whether American Pipe tolling covers the Section 11 statute of repose.  The piece focuses on due process questions that arise in this decision, and the potential implications for Section 10(b) litigation.  It also covers the potential impact of IndyMac on institutional investor activism in large securities matters, which has been growing steadily since the financial crisis.
